Natasha’s Law: Allergen labelling changes from 1st October 2021

What is this about?

In September 2019, The Food Information (Amendment) (England) Regulations 2019, more commonly known as Natasha’s Law, was laid in parliament. Its main aim was to introduce stricter requirements for pre-packaged foods to carry a full ingredients list, protecting those with allergies and give them greater confidence in the food they buy.

Natasha’s Law comes into effect on 1st October 2021. From then, any food, including chocolates and confectionery, you sell that is prepared on site and pre-packed for direct sale, (PPDS), will need to be correctly labelled with the name of the food and a full ingredients list.

What does pre-packed for direct sale (PPDS) mean?

Food, including chocolates and confectionery, that are pre-packed for direct sale are packaged at the same place that they are offered for sale or sold to customers: These chocolates and confectionery are in the packaging before they are ordered or picked up by a customer. If you sell chocolates or confectionery that is not in packaging, or is packaged as / after a customer orders it, it is not classed as PPDS. As such, selling loose chocolates directly from your display to the customer isn’t affected by Natasha’s Law but packing a box of chocolate to put on the shelf to sell is.

Examples of PPDS products include:

• A bag of chocolate gingers;
• A single chocolate novelty in a bag; and
• A mixed assortment ballotin.

What information needs to be provided with the PPDS product?

The information must include the name of the food and an ingredients list, with any allergenic ingredients emphasised every time they appear in the list, for example using bold or capitalisation, as shown to the right.

The list of all the ingredients needs to be arranged in descending order by weight.

As the retailer you are responsible for ensuring that any PPDS is labelled correctly.

All the information you will need is contained on the manufacturer’s label on every product you receive from us. We also have this ingredient information in digital format and have templates to assist you in producing information, which you may also choose to use, as well as some how-to guides.

If using the data supplied by ourselves, please check this against the manufacturer’s own ingredients list for the product after you receive a fresh delivery. Remember the onus is on you as the retailer to ensure that any PPDS product is labelled correctly.

Although we will update the spreadsheet when we are advised by manufacturers, we cannot guarantee that the information in the file will always be correct, and cannot advise all customers every time the spreadsheet has been updated as with over 550 products this will likely be updated often.

THE PANDEMIC & THE SUPPLY CHAIN

During the pandemic we’ve remained open for business. We've been very careful to ensure regular Covid-testing for staff plus social distancing and mask wearing when they move around our offices. The aim remains to make sure that we don't have to close temporarily if someone tests positive for Covid and other staff members also have to isolate. This has worked extremely well so far.

Our warehouses are currently full, with very good stock levels on the majority of our ranges and the processing of orders by our telesales team and the picking and packing of orders for shipment, by our warehouse team being very quick. We are frequently achieving next-day deliveries, which is the default outside of pandemics. However, all couriers still have much higher workloads than they had before the pandemic and aren't always able to achieve next-day delivery, after orders leave our warehouse. A shortage of drivers and vans has meant that some couriers have even had to turn down new business, for the first time ever. So, if you have a particular deadline, please help us to help you by ordering well in advance. You may be surprised and get it next day but it is normal within a few days at present. Thank you.
