Natasha’s Law: Allergen labelling changes from 1st October 2021

What is this about?

In September 2019, The Food Information (Amendment) (England) Regulations 2019, more commonly known as Natasha’s Law, was laid in parliament. Its main aim was to introduce stricter requirements for pre-packaged foods to carry a full ingredients list, protecting those with allergies and give them greater confidence in the food they buy.

Natasha’s Law came into effect on 1st October 2021. So now, any bulk food (including chocolates and confectionery) that you pre-pack yourself on your premises, for sale on the same premises, is referred to as 'pre-packed for direct sale' (PPDS). These PPDS packs must now be correctly labelled with the name of the food and a full ingredients list, with allergens highlighted.

What does pre-packed for direct sale (PPDS) mean?

PPDS refers to bulk food (including chocolates and confectionery) that is:

  1. Packaged at the same place it is offered for sale to customers (face-to-face selling)
  2. Already in the packaging before it is ordered or selected by a customer

Examples of PPDS products include:

  • A bag of chocolate gingers
  • A single chocolate novelty in a bag
  • A mixed assortment ballotin.

Food that isn’t PPDS

Any food that is not in packaging or is packaged AFTER being ordered by the consumer is not classed as PPDS. These are types of non-prepacked food and do not require a label with name, ingredients and allergens emphasised. Allergen information must still be provided but this can be done through other means, including orally though, less riskily, via signage. An example of this is the loose chocolate range that you may sell from your loose chocolate fridge.

Food packed by one business and supplied to another business is also not considered as PPDS, because it is not sold directly to the public. This is prepacked food and already must have full labelling, including the name of the food and a full ingredients list, with allergenic ingredients emphasised within it, nutritional information, etc.

What information needs to be provided with the PPDS product?

The information must include the name of the food and an ingredients list, with any allergenic ingredients emphasised every time they appear in the list, for example using bold or capitalisation, as shown to the right.

The list of all the ingredients needs to be arranged in descending order by weight.

What have Sarunds done to help you be compliant?

As the retailer you are responsible for ensuring that any PPDS is labelled correctly.

All the information you need is already contained on the manufacturer’s label on every product you receive from us. However, we also have this ingredient information in digital format to help you produce compliant labels and signage more quickly, as well as some templates which you may also choose to use, and some how-to guides.

If using the data supplied by Sarunds, please check this against the manufacturer’s own ingredients list for the product after you receive a fresh delivery. Remember the onus is on you as the retailer to ensure that any PPDS product is labelled correctly.

Although we will update the spreadsheet when we are advised of recipe changes by manufacturers, we cannot guarantee that the information in the file will always be correct, and cannot advise all customers every time the spreadsheet has been updated, as with over 550 products this will likely be updated frequently.

THE PANDEMIC & THE SUPPLY CHAIN

During the pandemic we’ve remained open for business. We've been very careful to ensure regular Covid-testing for staff plus social distancing and mask wearing when they move around our offices. The aim remains to make sure that we don't have to close temporarily if someone tests positive for Covid and other staff members also have to isolate. This has worked extremely well so far.

Our warehouses are currently full, with very good stock levels on the majority of our ranges and the processing of orders by our telesales team and the picking and packing of orders for shipment, by our warehouse team being very quick. We are frequently achieving next-day deliveries, which is the default outside of pandemics. However, all couriers still have much higher workloads than they had before the pandemic and aren't always able to achieve next-day delivery, after orders leave our warehouse. A shortage of drivers and vans has meant that some couriers have even had to turn down new business, for the first time ever. So, if you have a particular deadline, please help us to help you by ordering well in advance. You may be surprised and get it next day but it is normal within a few days at present. Thank you.
